To the extent permitted under applicable law, Billit’s liability shall be limited to damage resulting directly from gross negligence or wilful misconduct and shall be limited to the actual, direct damage you have suffered.
To the extent permitted under applicable law, Billit shall only be liable for direct damage caused by Billit that was foreseeable. Billit’s maximum liability under these Terms and Conditions is limited, per event or series of related events and in total per year, to the highest of the following amounts: (i) One euro (€1); or (ii) the amounts actually paid out under its professional liability insurance for the event giving rise to the damage.
To the extent permitted under applicable law, Billit shall not be liable for (i) indirect, punitive, special, consequential or similar damages (including damages for loss of profits, lost revenue, loss of business, loss or damage to data, loss of goodwill and reputational damage incurred through the use of the Website or any content available on it); and (ii) damage caused by the User or by third parties or for any act or omission based on content available on our Website.
Billit shall in no event be liable for any damage caused by you or third parties.

Force Majeure. Billit shall not be responsible or liable for any failure or delay in the performance of its obligations under these Terms and Conditions arising out of or caused by a Force Majeure Event. A ‘Force Majeure Event’ shall mean any circumstance that is reasonably beyond the control of a party, including but not limited to natural disasters, floods, droughts, earthquakes or other natural disasters; epidemics or pandemics; terrorist attacks, civil wars, domestic unrest or riots, war, threat of or preparation for war, armed conflict, the imposition of sanctions, embargo or the severance of diplomatic relations; nuclear, chemical or biological contamination; any law or measure taken by a government or public authority, including the imposition of an export or import restriction, quota or ban; collapse of buildings, fire, explosion or accident; labour or trade disputes, strikes, industrial action or lockouts; failure of suppliers or subcontractors; interruption or failure of utilities (including interruption or failure of the internet or any other public telecommunications network); cybersecurity incidents such as a hacker attack or denial-of-service attack; and viruses or other attacks involving malicious software. In the event of a Force Majeure Event, Billit will take measures to minimise the consequences of the Force Majeure Event.
Transfer. Billit may assign, transfer and/or outsource the rights and obligations under these Terms and Conditions to third parties.
Divisibility. If any provision of these Terms and Conditions (in whole or in part) proves to be unenforceable, the remaining provisions shall nevertheless remain in full force and effect. Any provisions that are found to be unenforceable shall be enforceable to the extent permitted under applicable law.
Applicable Law. These Terms and Conditions shall be governed by and interpreted in accordance with Belgian law, and the parties submit to the exclusive jurisdiction of the courts of Antwerp (Antwerp division), Belgium. The foregoing does not affect the consumer’s right to submit a dispute to a competent court on the basis of a mandatory legal provision.
Disputes. Before initiating proceedings before the competent courts, you should make every reasonable effort in good faith to seek an amicable resolution to any disputes arising during the implementation of these Terms and Conditions. Therefore, we kindly ask that you contact us first.
